1 Overview of FistBump Sports

FistBump Sports is a social sports engagement platform designed to allow users to interact with sports content, participate in entertainment-based prediction experiences, engage with sports communities, access promotional features, view content, participate in platform activities, and, where available, participate in lawful contests, sweepstakes, rewards, or promotional campaigns.

FistBump Sports is not a sportsbook. FistBump Sports does not offer real-money sports betting, gambling, casino gaming, sportsbook services, paid wagering, deposit-based betting, bookmaking, lottery ticket sales, or financial gaming. Unless expressly stated in separate official rules, such items have no cash value, cannot be redeemed for cash, cannot be sold, cannot be transferred, and do not represent deposits, balances, winnings, securities, stored value, financial instruments, money transmission accounts, or monetary accounts.

FistBump Sports reserves the right to restrict, disable, cancel, suspend, or remove any activity that appears to involve gambling, unauthorized wagering, collusion, manipulation, fraud, exploitation, abuse, prohibited conduct, or violation of law.

FistBump Sports does not provide betting advice, gambling advice, financial advice, investment advice, legal advice, tax advice, or professional advice of any kind. No content on the platform should be used to make gambling, wagering, financial, investment, legal, tax, medical, safety, or other high-risk decisions.

FistBump Sports does not guarantee the accuracy, completeness, timeliness, reliability, or official status of sports information, scores, statistics, schedules, predictions, rankings, or user-generated content. You are responsible for independently verifying any information before relying on it.

5 Separate Official Rules for Contests, Sweepstakes, and Promotions

From time to time, FistBump Sports may offer contests, sweepstakes, giveaways, rewards, referral campaigns, sponsor promotions, leaderboard promotions, prediction challenges, digital collectible promotions, or other promotional experiences. 6 Accounts and Registration

You may not create an account using false information, impersonate another person, use another person's account without permission, create multiple accounts to gain unfair advantage, sell or transfer your account, or use automated methods to create or access accounts.

You agree to notify FistBump Sports promptly if you believe your account has been compromised or used without authorization. FistBump Sports is not responsible for losses arising from unauthorized use of your account unless required by applicable law.

7 User Conduct

You agree to use the services responsibly, lawfully, and respectfully. You may not:

• Violate any federal, state, local, international, or regulatory law;

• Reverse engineer, decompile, copy, scrape, crawl, index, frame, mirror, or extract platform data except as permitted by law;
• Manipulate rankings, contests, leaderboards, rewards, entries, predictions, outcomes, referrals, ratings, reviews, engagement metrics, or platform results; or
• Use multiple accounts, fake accounts, automated tools, VPN manipulation, location spoofing, device spoofing, identity masking, proxy routing, or other evasion methods to bypass restrictions.

You also may not sell, trade, assign, transfer, sublicense, or commercialize platform access, accounts, rewards, points, entries, virtual items, badges, streaks, or digital collectibles; interfere with the operation, security, fairness, or integrity of the services; submit false reports, false claims, false eligibility information, false tax information, false prize documentation, or false ownership information; or encourage, assist, or enable others to violate these Terms.

FistBump Sports may investigate and take action against conduct that violates these Terms, including warnings, content removal, feature restriction, account suspension, account termination, disqualification from promotions, reward cancellation, reporting to authorities, and legal action.

8 Community Standards

FistBump Sports is built to support positive sports engagement. Competitive banter is permitted when respectful and lawful. Abuse is not permitted.

Users may not post or share content that includes personal attacks, threats, targeted harassment, doxxing, hate speech, sexually explicit material, graphic violence, unlawful instructions, self-harm encouragement, exploitation of minors, illegal betting solicitations, deceptive promotional activity, false endorsements, unauthorized advertising, spam, or malicious links.

FistBump Sports may moderate, review, remove, restrict, hide, decline to display, or preserve user content at its discretion. We are not obligated to monitor all activity, but we reserve the right to do so to protect users, comply with law, enforce these Terms, preserve platform integrity, and maintain a responsible user experience.

9 User Content

The services may allow you to submit, post, upload, display, transmit, or share content, including comments, usernames, profile information, photos, videos, reactions, sports predictions, messages, reviews, ratings, feedback, ideas, contest submissions, referral content, and other materials.

You retain ownership of content you own. By submitting content to FistBump Sports, you grant FistBump Sports a worldwide, non-exclusive, royalty-free, fully paid, transferable, sublicensable license to host, use, reproduce, modify, adapt, publish, translate, distribute, display, perform, promote, analyze, moderate, preserve, and create derivative works from your content in connection with operating, improving, promoting, protecting, and enforcing the services.

You represent and warrant that you own or have all necessary rights to submit your content; your content does not violate the rights of any person or entity; your content does not violate law, these Terms, official rules, app-store rules, or community standards; your content is not false, misleading, defamatory, obscene, exploitative, unlawful, or harmful; your content does not include confidential information that you are not authorized to disclose; and your content does not include personal information of another person without lawful authority or consent.

FistBump Sports may remove, restrict, preserve, or report any content at any time. Removal does not waive any right or remedy available to FistBump Sports.

10 Feedback and Suggestions

If you submit ideas, suggestions, concepts, improvements, product requests, designs, feature recommendations, business proposals, marketing concepts, or other feedback to FistBump Sports, you agree that FistBump Sports may use them without restriction, compensation, attribution, obligation, or liability.

You agree not to submit confidential, proprietary, or trade-secret information through general feedback channels unless we have entered into a separate written agreement signed by an authorized representative of FistBump Sports.

11 Intellectual Property

The website, application, platform, software, designs, graphics, logos, icons, trademarks, service marks, trade names, slogans, text, videos, photographs, interfaces, features, databases, source code, object code, workflows, scoring logic, user experience designs, platform architecture, promotional materials, and all related content are owned by FistBump Sports or its licensors and are protected by intellectual property, unfair competition, and other laws.

You may not copy, reproduce, modify, distribute, sell, lease, sublicense, display, perform, publish, reverse engineer, decompile, create derivative works from, or exploit any FistBump Sports intellectual property except as expressly permitted by these Terms or by written authorization from FistBump Sports.

12 Third-Party Trademarks, Teams, Leagues, Athletes, and Sports Content

FistBump Sports may reference sports teams, leagues, athletes, events, statistics, schedules, scores, brands, sponsors, venues, media, or third-party content for identification, commentary, engagement, informational, promotional, or entertainment purposes.

Unless expressly stated, FistBump Sports is not affiliated with, endorsed by, sponsored by, approved by, or officially connected to any professional league, sports organization, team, athlete, player association, governing body, event operator, media company, statistics provider, app store, sponsor, advertiser, or brand.

All third-party names, trademarks, logos, images, and brands are the property of their respective owners. Use of such names, trademarks, logos, or references does not imply endorsement, sponsorship, approval, or affiliation.

13 Platform Points, Badges, Entries, Rankings, Rewards, and Virtual Items

FistBump Sports may offer points, badges, achievements, streaks, entries, digital collectibles, rankings, leaderboard positions, virtual items, or similar engagement features.

Unless expressly stated in separate official rules, these items are promotional or entertainment features only; have no cash value; are not deposits, balances, winnings, securities, financial products, stored value, money transmission products, or currency; cannot be redeemed for cash; cannot be sold, exchanged, transferred, assigned, inherited, or pledged; may be modified, expired, limited, revoked, or discontinued at any time; and do not create property rights, vested rights, ownership rights, or contractual payment rights.

FistBump Sports may correct errors, adjust points, remove entries, modify leaderboards, reverse rewards, cancel suspicious activity, and disqualify users where necessary to preserve fairness, security, compliance, or platform integrity.

14 Rewards and Prize Fulfillment

Where lawful rewards or prizes are offered, fulfillment may be subject to eligibility verification, identity verification, age verification, location verification, tax documentation, fraud review, sponsor approval, inventory availability, shipping limitations, and compliance requirements.

FistBump Sports is not responsible for delays or failures caused by inaccurate user information, shipping carrier issues, third-party vendor delays, customs restrictions, tax documentation delays, force majeure events, or failure to satisfy eligibility requirements.

Prizes and rewards are not guaranteed unless awarded in accordance with applicable official rules. FistBump Sports may substitute a prize or reward of equal or greater approximate value where permitted by law and applicable official rules.

Users are responsible for any taxes, costs, fees, reporting obligations, or expenses associated with accepting or using a prize or reward unless the applicable official rules state otherwise.

15 Sponsored Content, Advertising, Endorsements, and Promotions

You may not create false reviews, fake endorsements, fake engagement, undisclosed paid promotions, misleading testimonials, manipulated ratings, deceptive advertising content, or unauthorized promotional content involving FistBump Sports.

FistBump Sports may remove or reject promotional content that does not meet legal, ethical, community, sponsor, app-store, or platform standards.

16 Mobile Application and App Store Terms

If you access FistBump Sports through a mobile application, your use may also be governed by the terms, conditions, and policies of the applicable app store, mobile platform, device provider, operating system provider, payment provider, or third-party service.

You are responsible for complying with all applicable app-store rules and device requirements. FistBump Sports does not guarantee that the application will be compatible with every device, operating system, carrier, network, region, or software version.

Apple Inc., Google LLC, and other app-store or platform providers are not parties to these Terms unless their own terms state otherwise. App-store providers are not responsible for the FistBump Sports services, content, promotions, rewards, support, maintenance, claims, user disputes, or legal compliance except as required by their own applicable terms or applicable law.

If app-store rules conflict with these Terms, the app-store rules may control your use of the application on that platform only to the extent of the conflict.

The services may contain links to third-party websites, services, platforms, advertisers, sponsors, payment processors, analytics providers, social networks, app stores, cloud services, mapping tools, identity-verification providers, fulfillment providers, statistics providers, or other resources.

A link to a third-party service does not mean FistBump Sports endorses, controls, guarantees, or assumes responsibility for that service.

30 Platform Integrity, Fraud Prevention, and Enforcement

FistBump Sports may take action including account review, content removal, point adjustment, leaderboard correction, entry cancellation, reward cancellation, promotion disqualification, access restriction, account suspension, account termination, device blocking, legal action, and referral to law enforcement.

FistBump Sports is not required to disclose detection methods, security logic, risk rules, scoring rules, anti-fraud tools, review criteria, investigation details, or moderation logic.

31 Suspension and Termination

You may stop using the services at any time. FistBump Sports may suspend, restrict, terminate, or delete your account or access to the services at any time if we believe that you have violated these Terms, violated applicable law, created risk, harmed another user, compromised platform integrity, submitted false information, engaged in suspicious activity, or used the services in a manner inconsistent with their intended purpose.

Upon termination, your right to use the services ends immediately. Sections that by their nature should survive termination will survive, including intellectual property, user content licenses, feedback rights, disclaimers, limitations of liability, indemnification, dispute resolution, arbitration, governing law, and other provisions necessary to enforce these Terms.

FistBump Sports does not warrant that the services will meet your expectations; the services will be uninterrupted, secure, timely, or error-free; content, statistics, scores, predictions, rankings, or data will be accurate or complete; defects will be corrected; the services will be free of viruses, malware, or harmful components; or any reward, prize, promotion, leaderboard result, or engagement outcome will be available, accurate, final, or error-free.

No advice, information, or communication from FistBump Sports creates any warranty not expressly stated in these Terms.

34 Limitation of Liability

To the fullest extent permitted by law, FistBump Sports and its officers, directors, employees, contractors, agents, affiliates, licensors, sponsors, vendors, service providers, successors, and assigns will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, including lost profits, lost revenue, lost data, loss of goodwill, loss of use, business interruption, device damage, unauthorized access, service interruption, failed promotion entry, lost reward, delayed prize, or loss arising from or related to your use of the services.

To the fullest extent permitted by law, FistBump Sports' total liability for any claim arising out of or relating to these Terms or the services will not exceed the greater of the amount you paid directly to FistBump Sports for the specific service giving rise to the claim during the six months before the claim arose, or one hundred dollars.

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, liability will be limited to the maximum extent permitted by law.

35 Indemnification

You agree to defend, indemnify, and hold harmless FistBump Sports and its officers, directors, employees, contractors, agents, affiliates, licensors, sponsors, vendors, service providers, successors, and assigns from and against any claims, damages, losses, liabilities, costs, penalties, fines, and expenses, including reasonable attorneys' fees, arising out of or related to your use or misuse of the services; your violation of these Terms; your violation of official rules; your violation of applicable law; your user content; your infringement or misappropriation of any third-party rights; your fraud, misconduct, manipulation, abuse, or unauthorized activity; your violation of contest, promotion, reward, or eligibility requirements; or your violation of app-store, sponsor, third-party service, or platform requirements.

FistBump Sports reserves the right to control the defense and settlement of any matter subject to indemnification. You agree to cooperate with our defense.

36 Informal Dispute Resolution

Before filing any claim, arbitration demand, or court action, you and FistBump Sports agree to first attempt to resolve the dispute informally.

A party seeking to bring a dispute must send written notice describing the dispute, the relief requested, and contact information to FistBump Sports, Inc., 2942 Century Pl, Ste 790, Costa Mesa, CA 92626, Email: Info@FistBumpSports.Com.

The parties will attempt in good faith to resolve the dispute within 30 days after notice is received. If the dispute is not resolved within that period, either party may proceed as allowed under these Terms.

37 Arbitration Agreement and Class Action Waiver

Except for disputes that qualify for small claims court, claims for injunctive relief involving intellectual property or unauthorized access, claims involving misuse of confidential information, or claims that cannot be arbitrated as a matter of law, you and FistBump Sports agree that any dispute, claim, or controversy arising out of or relating to these Terms, the services, your account, promotions, rewards, user content, communications, or relationship with FistBump Sports will be resolved by binding individual arbitration.

The arbitration will be administered by a recognized arbitration provider under its applicable consumer arbitration rules, unless the parties agree otherwise. The arbitration will be conducted in English. The arbitrator will have authority to resolve disputes regarding arbitrability, enforceability, interpretation, and scope, except where prohibited by law.

You and FistBump Sports agree that disputes will be resolved only on an individual basis. You may not bring claims as a plaintiff or class member in any class action, collective action, consolidated action, private attorney general action, or representative proceeding, except where this waiver is prohibited by law.

You may opt out of this arbitration agreement by sending written notice to Info@FistBumpSports.Com within 30 days after first accepting these Terms. Your opt-out notice must include your name, account email, and a clear statement that you opt out of arbitration.

If any portion of this arbitration section is found unenforceable, the remaining portions will remain in effect unless the class action waiver is found unenforceable in a way that permits class arbitration, in which case this arbitration section will be void as to that dispute.

38 Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent preempted by federal law or otherwise required by applicable consumer protection law.

Subject to the arbitration agreement above, any court proceeding must be brought in the state or federal courts located in Orange County, California, unless applicable law requires a different venue.

You and FistBump Sports consent to the personal jurisdiction of those courts.

39 International Users

FistBump Sports is operated from the United States. We do not represent that the services are appropriate or available in all jurisdictions. If you access the services from outside the United States, you are responsible for complying with local laws.

FistBump Sports may restrict access to certain features, promotions, rewards, or services based on location, legal requirements, operational limitations, app-store restrictions, or compliance risk.

40 Export Control and Sanctions

You may not use the services if you are located in, organized under the laws of, or ordinarily resident in a country or region subject to comprehensive U.S. sanctions, or if you are listed on any U.S. government restricted-party list.

You may not use the services for any purpose prohibited by export control, sanctions, anti-money laundering, anti-bribery, anti-corruption, or other applicable laws.

41 Force Majeure

FistBump Sports will not be liable for delay or failure to perform caused by events beyond its reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, internet outages, cyberattacks, security incidents, utility failures, government action, regulatory changes, app-store action, data-provider failure, payment-provider failure, shipping disruption, pandemic, epidemic, sponsor failure, or other events beyond reasonable control.

42 Changes to These Terms

FistBump Sports may update these Terms from time to time. When we make changes, we may update the Last Updated date and, where required, provide notice through the website, application, email, account message, or other reasonable method.

Your continued use of the services after updated Terms become effective means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the services.

Material changes will not apply retroactively unless permitted by law.

43 Assignment

You may not assign or transfer these Terms, your account, or your rights or obligations without prior written consent from FistBump Sports.

FistBump Sports may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, financing, restructuring, sale of assets, corporate transaction, operation of law, or transfer of business operations.

44 Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

45 No Waiver

FistBump Sports' failure to enforce any provision of these Terms is not a waiver of that provision or any other provision. Any waiver must be in writing and signed by an authorized representative of FistBump Sports.

46 Entire Agreement

These Terms, together with the Privacy Policy, official rules, supplemental terms, community guidelines, app terms, and any other policies expressly incorporated by reference, constitute the entire agreement between you and FistBump Sports regarding the services.

These Terms supersede any prior or contemporaneous agreements, communications, understandings, or representations regarding the services.
